Terms of Service
Last updated: July 11, 2026
Welcome to Truth Local. In plain English: Truth Local is a platform where small businesses and franchise networks purchase monthly advertising packages, and our team plans and runs the campaigns. These Terms of Service explain the rules for using the platform — how subscriptions and billing work, what you're responsible for, what we're responsible for, and what happens if something goes wrong. Please read them; by using Truth Local you agree to them. Our Privacy Policy explains how we handle your information and is part of this agreement.
These Terms of Service (the "Terms") are a binding agreement between Truth Local LLC, a Truth Marketing + Media company ("Truth Local," "we," "us," or "our"), and the business on whose behalf you use truthlocal.com and the services offered through it (the "Service").
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
- You must be at least 18 years old to use the Service. The Service is not directed at children, and we do not knowingly collect information from children under 13.
- The Service is offered for business use only. It is a business-to-business platform and is not intended for personal, family, or household purposes.
- If you use the Service on behalf of a business, you represent and warrant that you have the authority to bind that business to these Terms, and "you" and "Customer" refer to that business.
2. The Service
Truth Local is a self-serve and agency-managed local advertising platform for small businesses and franchise networks. Customers purchase monthly subscription packages that include managed media campaigns across advertising channels such as search, social, connected TV (CTV), video, audio, and display. Truth's ad-operations team sets up and manages the campaigns included in your package. The specific channels, included ad spend, and management services vary by package tier and are described at the time of purchase.
Some business accounts are provisioned by a corporate or franchise program, or by agency administrators, rather than created directly by the business. If your account is part of a corporate or franchise program, the administrators of that program can see your business information within the program. If you joined through a corporate or franchise program, your participation may also be subject to the terms of that program.
3. Accounts & Security
You must provide accurate and complete information when creating an account and keep it up to date. You may sign in with an email address and password or through Google sign-in.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- Notify us promptly at hello@truth.agency if you suspect unauthorized access to or use of your account.
- We may suspend or terminate accounts that provide false information or are used in violation of these Terms.
4. Subscriptions, Billing & Auto-Renewal
Automatic renewal notice
Truth Local subscriptions AUTOMATICALLY RENEW EACH MONTH, and your payment method will be charged the subscription price disclosed at checkout at the start of each monthly billing period, UNTIL YOU CANCEL. You can cancel at any time through your account or by contacting support at hello@truth.agency. Cancellation takes effect at the end of your current billing period, and you will not be charged again after that.
- Pricing. The price of your subscription, including what is included in your package, is disclosed at checkout before you purchase.
- Payment processing. Payments are processed by Stripe, our third-party payment processor. We never receive or store your card number; we retain only Stripe customer and subscription identifiers.
- No refunds. Fees are non-refundable except where a refund is required by applicable law.
- Package contents. Included ad spend and management services vary by package tier as described at the time of purchase.
- Non-payment. If a payment fails, we will attempt to collect it (a "dunning" process). If payment is still not received, we may suspend the Service, including pausing your campaigns, until your account is brought current.
5. Ad Content & Acceptable Use
You are responsible for the content, offers, and claims in the advertising we run on your behalf and for the materials you provide to us. You agree that you will not use the Service for any unlawful, deceptive, or misleading advertising.
- You must comply with all applicable laws and regulations, including FTC truth-in-advertising rules, and with the advertising policies of the platforms on which your campaigns run (such as Google and Meta).
- You represent and warrant that you own or have all necessary rights to the assets and content you provide to us (including logos, images, brand materials, and copy), and that the claims you make about your business, products, and services are accurate.
- You grant Truth Local a license to use the assets and content you provide solely as needed to deliver the Service, as described in Section 7.
- Truth Local may reject, pause, or remove any advertising that we reasonably believe violates applicable law or the policies of an advertising platform.
6. No Performance Guarantee
Advertising outcomes depend on many factors outside our control, including your market, your offer, seasonality, and the behavior of advertising platforms. Truth Local does not guarantee any particular results from the Service, including impressions, clicks, leads, conversions, return on ad spend (ROAS), or revenue. Any performance figures, estimates, or projections we share are illustrative only and are not commitments.
7. Intellectual Property & License to Customer Assets
You retain all ownership of your content, trademarks, and brand assets. You grant Truth Local a non-exclusive license to use, reproduce, modify, and display the assets and content you provide solely for the purpose of delivering the Service — for example, building ad creative, running campaigns, and operating your account. This license ends when it is no longer needed to provide the Service or comply with law.
Truth Local retains all rights, title, and interest in and to the Service, including the platform, software, tools, templates, workflows, and everything we build or develop, except for your content and marks. No rights are granted to you other than the limited right to use the Service in accordance with these Terms.
8. Third-Party Services
The Service relies on third-party providers, and your use of the Service may be subject to their terms. For example, payments are processed by Stripe and are subject to Stripe's terms, and campaigns run on advertising platforms (such as Google and Meta) that apply their own policies to ad content and delivery. We also use service providers such as Resend (email delivery), Anthropic (AI chat), Mapbox (geocoding and maps), Google (sign-in), Pexels (stock media in the creative studio), and cloud hosting and database providers. Truth Local is not responsible for the acts or omissions of third-party platforms, including changes to their policies, pricing, or availability. Our Privacy Policy describes how these providers handle your information.
9. Termination & Suspension
- You may cancel your subscription at any time as described in Section 4; cancellation takes effect at the end of the current billing period.
- Either party may terminate these Terms if the other party materially breaches them and fails to cure the breach within a reasonable time after notice.
- We may suspend the Service for non-payment as described in Section 4, or suspend or remove advertising as described in Section 5.
- Upon termination, your right to use the Service ends. Sections that by their nature should survive termination — including payment obligations, intellectual property, disclaimers, limitation of liability, and indemnification — survive.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUTH LOCAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR ADVERTISING RESULTS WILL BE ACHIEVED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) TRUTH LOCAL'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE FEES YOU PAID TO TRUTH LOCAL IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; AND (B) TRUTH LOCAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY.
12. Indemnification
You will defend, indemnify, and hold harmless Truth Local and its affiliates, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) the content and assets you provide; (b) your products, services, and business operations; (c) the claims you make about your business; or (d) your breach of these Terms or violation of applicable law.
13. Governing Law & Disputes
These Terms are governed by the laws of [GOVERNING LAW STATE — TO BE CONFIRMED WITH COUNSEL], without regard to its conflict-of-laws rules, and any disputes arising out of or relating to these Terms or the Service will be brought in the courts located in [GOVERNING LAW STATE — TO BE CONFIRMED WITH COUNSEL]. Before filing any claim, we encourage you to contact us at hello@truth.agency so we can try to resolve the issue informally.
14. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will provide notice — for example, by email or through the Service — before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should cancel your subscription and stop using the Service.
15. General Provisions
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
- Entire agreement. These Terms, together with the Privacy Policy and any package descriptions or order details presented at checkout, are the entire agreement between you and Truth Local regarding the Service.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control, including natural disasters, outages of third-party platforms, acts of government, or labor disputes (except that payment obligations are not excused).
